1. Services Provided

We specialize in building free professional websites for small businesses. The website design and build are free when you subscribe to one of our paid monthly hosting plans. Hosting plans include maintenance, updates, and access to marketing tools such as analytics and AI chat widgets.

Our services may include:

• Web design and hosting setup

• SEO and content optimization

• AI chat, lead capture, and automation

• Ongoing maintenance and updates

We reserve the right to modify or discontinue any service, feature, or pricing plan at any time.

2. Setup Fees and Monthly Hosting

A one-time setup fee is charged for onboarding, design, and website deployment. The fee amount depends on your selected plan ($197 for the $97/month plan, $397 for the $297/month plan, or a custom amount for tailored projects). Setup fees may be waived during limited promotions.
Hosting plans are billed monthly until canceled.
If hosting is canceled before 12 months, a prorated $500 early-termination fee applies to recover setup and development costs.

Billing details are displayed at checkout and on your agreement confirmation.

3. Cancellations and Refunds

You may cancel your hosting at any time.
However, cancellations before 12 months of active service are subject to the build-recovery fee outlined above.

Setup fees and completed design work are non-refundable once production begins.

4. Client Responsibilities

Clients agree to:

• Provide accurate business information for design and hosting setup.

• Supply all text, images, and content they own or have rights to use.

• Maintain compliance with all applicable laws.

We reserve the right to suspend or terminate accounts that misuse our platform or violate these terms.

5. Intellectual Property

All website templates, designs, and proprietary tools used on this platform remain the property of FIGBAR Consulting LLC unless otherwise stated in a signed agreement.

Clients retain ownership of their original content (text, logos, and media). Upon cancellation, we may provide a copy of the client’s website content upon written request.

After the 12-month commitment is fulfilled and all invoices are current, ownership of the completed website design is transferred to the client.

6. Limitation of Liability

While we take great care in providing high-quality services, FIGBAR Consulting LLC shall not be liable for indirect, incidental, or consequential damages, including but not limited to data loss, business interruption, or lost profits.

We do not guarantee uninterrupted service and are not responsible for downtime caused by third-party providers.

7. Third-Party Tools

We integrate third-party services (such as hosting platforms, analytics, and automation software). Each third-party provider has its own terms and policies, which apply in addition to ours.

8. Changes to These Terms

We may update these Terms of Service at any time to reflect operational or legal changes.
